A settlement is the agreement between the two parties in a lawsuit. The plaintiff agrees to drop any claims against the defendant in exchange for an amount of money agreed upon by the two parties.
Some of the bigger name law firms have a reputation for settling claims for an amount that approaches the amount of the insurance company limit so as to reach a quick settlement. They probably do so because they don’t litigate cases (go to court). If there is a settlement, the attorneys produce a document called a Release giving the details of the terms that have been agreed upon and who is going to pay how much money in order to resolve the contested case.
Sometimes the settlement agreement include provisions where the defendant doesn’t admit guilt, or even that the settlement shall not be disclosed to the public, in order for the defendant to avoid bad publicity.
